We have a new name! Accomplished Artist Studio is now Hüezen.

Terms of Service

Hüezen · Effective November 2026

Welcome to Hüezen. These Terms of Service ("Terms," "Agreement") govern your access to and use of the website at huezen.art, the Artie app at artie.huezen.art, and all art instruction, classes, facilities, and services provided by Hüezen ("we," "us," or "our").

By visiting our website, creating an account in Artie, registering for classes, or participating in studio programs, you ("Student," "Parent/Guardian," or "User") agree to be bound by these Terms and our Privacy Policy and SMS Policy. If you do not agree to these Terms, do not use our services or enroll in classes.

1. Enrollment & Account Registration

1.1 Age Eligibility: 16 and Older

Hüezen is an adult studio. You must be at least sixteen (16) years old to enroll in classes or use the Artie app, and we do not offer programs for children under sixteen. If you are sixteen or seventeen, a parent or legal guardian must complete enrollment and agree to these Terms on your behalf, as described in Section 1.2.

1.2 Minors and Guardianship

If a student is under 18 years of age, a parent or legal guardian must complete enrollment, agree to these Terms on the student's behalf, and assume full financial responsibility for all tuition, fees, and actions of the student.

1.3 Account Security

Access to the Artie app is personal to you. You agree to maintain the confidentiality of your login credentials and immediately notify studio administration of any unauthorized access or security breach.

1.4 The Launch Program

New students enter an initial four (4) week introductory evaluation period ("Launch Program"). The Launch Program provides foundational instruction and allows our coaches and management to evaluate student readiness, safety, and engagement. Graduation into regular continuous enrollment is subject to coach evaluation and studio manager approval.

2. Tuition, Billing & Payment Terms

2.1 Recurring Tuition Subscription

By enrolling in regular classes or the Launch Program, you authorize Hüezen to automatically charge your designated payment method on file on a recurring billing cycle (typically every 4-week billing period or calendar month, as specified during checkout) for tuition and applicable fees. Recurring billing continues automatically until a formal drop request is submitted and confirmed in Artie.

2.2 Payment Processing

All payment transactions are processed through Stripe, a third-party, PCI-compliant payment gateway. By providing payment card information, you represent that you are authorized to use the designated card or account and authorize Stripe to store the payment credential for automatic off-session charges.

2.3 Enrollment Fees

A one-time enrollment fee is charged upon initial registration to cover administrative setup and student onboarding into Artie, our student app.

2.4 Late Payments & Non-Payment

If an automatic payment fails, you will receive an automated notification to update your payment method. If tuition remains past due, Hüezen reserves the right to cancel your enrollment.

2.5 Drop Policy & Notice

  • Submitting a Drop: All class drop requests must be submitted directly through Artie or confirmed verbally with studio management.
  • Timing: To avoid being billed for an upcoming billing cycle, drop requests must be submitted prior to the start of the next billing period. Once a billing cycle has commenced, tuition for that cycle is earned and non-refundable.
  • Finality: Drop requests confirmed in Artie are permanent. Re-enrollment is subject to current seat availability, tuition rates, and waitlist order.

2.6 Refund Policy

  • Tuition & Fees: Except as explicitly provided herein or required by law, tuition and fees are non-refundable once paid. That said, life happens — if you drop enrollment unexpectedly, haven't yet attended your first paid class, or need to withdraw for an emergency, talk to us and we'll make it right based on the circumstances.
  • Prorated Final Payment: If you select a drop date that falls in a future billing cycle, we'll prorate your final tuition payment to that date. If you don't, your tuition is already paid and non-refundable — even if you drop without attending every class you paid for.

3. Studio Operations, Attendance & Closures

3.1 Attendance & Absences

We track attendance for basic understanding of your enrollment and engagement. Tuition covers your reserved seat and your coach's time, so we don't offer make-up sessions or financial credits for missed classes.

3.2 Scheduled Holidays & Studio Events

The studio schedule accounts for scheduled holiday closures and special studio events. Billing cycles are structured to account for the studio's annual operating calendar. Planned closures are published in advance on the studio calendar in Artie and sent via studio announcements.

3.3 Inclement Weather & Emergency Closures

In the event of severe weather or emergency closures, Hüezen will notify affected students via email and SMS (for opted-in accounts).

4. Studio Safety, Conduct & Assumption of Risk

4.1 Fine Art Materials & Environment

Hüezen is a professional-grade working art studio. Instruction involves the use of specialized art supplies, including but not limited to professional oil paints, pigments, solvents (such as odorless mineral spirits), mediums, palette knives, easels, razor blades, and heavy studio furniture.

4.2 Assumption of Risk & Release of Liability

You acknowledge that working with studio tools and artistic materials carries inherent risks, including accidental stains, property damage, cuts, allergic reactions, slips, or falls. You, on behalf of yourself and/or your enrolled minor child:

  • Freely and voluntarily assume all risks associated with participation in studio classes and presence on studio premises.
  • Release, waive, and forever discharge Hüezen, its owners, coaches, employees, and agents from any and all liability, claims, or demands arising out of personal injury, property damage, or loss sustained while on studio premises or participating in studio-related activities, except where caused by gross negligence or willful misconduct.

4.3 Studio Property & Attire

  • Clothing: Studio materials (especially oil paint) can permanently stain clothing, shoes, and personal accessories. Hüezen is not responsible for damage to personal apparel.
  • Equipment Care: Students are expected to treat easels, lighting, and studio fixtures with care. Intentional misuse or malicious damage to studio property may result in replacement charges and immediate termination of enrollment.

4.4 Health, Allergies & Emergency Care

Parents and students must disclose any relevant medical conditions, food allergies, or special needs during enrollment in Artie. In the event of a medical emergency, you authorize Hüezen staff to administer basic first aid and, if necessary, contact emergency medical personnel (911) and your designated emergency contacts.

5. Artwork, Intellectual Property & Media Release

5.1 Student Artwork & Pickup Policy

Students retain full ownership of the original physical artwork they create. Completed physical artwork placed on drying racks or storage shelves must be picked up within thirty (30) days following completion or after dropping enrollment. Artwork left unclaimed after thirty (30) days may be repurposed, recycled, or disposed of by the studio without liability.

5.2 Hüezen Intellectual Property

All curriculum materials, lesson plans, instructional videos, demonstrations, slide decks, reference images, and written guides accessible via Artie or delivered in the studio are the exclusive proprietary property of Hüezen. You may not record, duplicate, distribute, publicly display, or commercially exploit any proprietary curriculum content without express written consent.

5.3 Media & Social Media Release

As part of our learning community and promotional activities:

  • Photos and video recordings of students engaged in class and photos of student artwork may be displayed within the Artie student gallery, on the Hüezen website, and across official social media channels to celebrate artistic accomplishments and promote studio programs.
  • If you prefer that you or your enrolled student not appear in public social media or marketing materials, you may opt out at any time by notifying studio management in writing.

6. Acceptable Use of the Artie App

You agree not to:

  • Attempt to circumvent user authentication, access controls, or role boundaries within Artie.
  • Introduce viruses, trojans, worms, or malicious code to the application.
  • Use automated scraping, spiders, or bots to harvest student, coach, or curriculum data.
  • Harass, abuse, or post defamatory content in any communication channels, feedback forms, or student galleries.

Violation of platform security or community guidelines may result in immediate suspension or termination of your account and enrollment.

7. Disclaimer of Warranties & Limitation of Liability

7.1 "As Is" Provision

The website, the Artie app, and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability.

7.2 Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Hüezen, its directors, employees, or contractors be liable for any indirect, incidental, special, punitive, or consequential damages resulting from your use of the website, the Artie app, or participation in studio classes. Hüezen's total aggregate liability under this Agreement shall not exceed the total amount of tuition fees paid by you to Hüezen during the three (3) months preceding the event giving rise to liability.

8. Dispute Resolution & Governing Law

Talk to Us First: Most concerns can be settled with a simple conversation. Before filing any claim, you agree to contact us at info@huezen.art with a short description of the issue and the outcome you're looking for. Both sides agree to try in good faith to resolve it informally for at least thirty (30) days before starting any formal proceeding.

Individual Claims Only: To the fullest extent permitted by law, you and Hüezen agree that any dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. Nothing in this section prevents either party from bringing an individual claim in small claims court.

These Terms and any disputes arising out of or related to your relationship with Hüezen shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Salt Lake County or Utah County, Utah, and you consent to the personal jurisdiction thereof.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. When material updates are made, we will update the "Effective Date" above and provide notification via Artie, email, or a prominent notice on our website. Continued enrollment or use of Artie following such notice constitutes acceptance of the revised Terms.

10. Indemnification

You agree to defend, indemnify, and hold harmless Hüezen, Accomplished Artist™ LLC, and its owners, coaches, employees, and agents from and against any third-party claims, demands, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your use of the website or the Artie app, or (c) your conduct on studio premises or at a studio event. We will notify you of any claim covered by this section, and you may not settle a claim in a way that affects us without our written consent. This section does not apply to claims caused by Hüezen's gross negligence or willful misconduct.

11. Entire Agreement

These Terms, together with our Privacy Policy, our SMS Policy, and any separate written agreement you sign with the studio, are the complete and exclusive agreement between you and Hüezen regarding the website, Artie, and studio services. They replace any earlier or contemporaneous understandings about those services, whether written or oral. Statements on our website, in class, or in studio emails are for information and encouragement only and do not modify these Terms. No failure by Hüezen to enforce any provision is a waiver of that provision or of any other provision.

12. Severability

If a court or other authority finds any part of these Terms invalid, unlawful, or unenforceable, that part will be changed to the minimum extent needed to make it enforceable, or removed if it cannot be changed, and every other part of these Terms will remain in full force and effect. Where a provision is removed, the parties intend that a valid provision closest to the original intent takes its place.
